 Title  Reform in the Area of the Governance of Common Issues to large Cities and their urbanized Solutions in the Polish Legal System

Abstract  
  
The main aim of this paper is to demonstrate of reform of the governance of common issues - especially realizaton of common investments – to large cities and their urbanized solutions. Considerations will be conducted from the perspective of the Polish legal system and the Polish public administration.

At the outset, it should be noted that in recent years the public authorities in Poland have taken several different initiatives aimed at solving the problem of the governance of common issues to large cities and their urbanized solutions. It is worth pointing out in this context that in August 2013 will be motioned by a group of Polish parliamentarians a draft act on metropolitan district (ustawa o powiecie metropolitalnym). At the same time, it should be stressed that for several years the Polish authorities have been implementing the quite new institution in the area of the governance of common issues to large cities and their urbanized solutions: the institution of integrated territorial investments (ITI). This institution will be the subject of a comprehensive analysis in this paper.

Integrated territorial investments will be analysed in presented paper as a basic at the moment – from the Polish perspective – the mechanism of realizaton of common investments to large cities and their urbanized solutions. ITI enable the cooperation between territorial self-government units in the urban functional area of the voivodeship center (and thus within the voivodship city and its functionally connected area).

Integrated territorial investments will be considered as a new method of implementing cooperation between local and regional authorities, which is already beyond the traditional concept of local government This tradicional concept - approved in the Polish legal system on constitutional and statutory level - is based on the distinction of three different levels of local government: municipal, district and provincial.

In addition, the author of this paper will emphasize that the institution of ITI constitutes a practical transplant into the Polish legal system from the proposals contained in the EU draft regulations for the cohesion policy (connected with the financial perspective of the EU for 2014-2020).

Using the formula of integrated territorial investments are made territorial strategies for integrated actions for sustainable urban development. At the same time, the essence of integrated territorial investment institutions is to support projects which are relevant to the whole functional area (and not only to projects that are important only to the large city).
