 Title  Legal Bases of Participatory Budgeting in Poland: Challenges and Solutions

Abstract  
  		 Procedural solutions adopted in Poland pertaining to participatory budgeting have changed for years. The basic questions included in this paper concern the questions:
1) whether there are any legal acts that directly regulate the participatory budgeting?;
2) whether there are legal solutions that indirectly regulate the participatory budgeting?;
3) on what legal basis the participatory budgeting functions?;
4) in what way the legal bases of the participatory budgeting evolve?
The research questions will be answered by analyzing the current Republic of Poland Constitution of 1997 and legal regulations concerning public consultation contained in the acts of law (on public benefit and volunteer work; on the provision of information about the environment and its protection, participation of the public in environmental protection and on the assessment of impact on the environment; on the principles of conducting the development policy; on social assistance; on the promotion of employment and labor market institutions; and on spatial planning and development). There will be also analyzed: the Act on Commune (Gmina) Self-Government of 8 March 1990; the Act on District Self-Government of June 1998; The Act on Voivodeship Self-Government of 5 June 1998 and their amendments of 11 January 2018 in which participatory budget was recognized as a special form of social consultations. With regard to rural areas, there will be analyzed the village council chair’s fund treated as a form of participatory budgeting in Poland. It is regulated by the Act of 21 February 2014 on the village chair’s fund. The paper is relevant for the working group, especially with the point 1. Connected withc local democracy and new forms of participation.
