The topic developed in this article is part of a complex research that aims to demonstrate that greater communication and collaboration between public authorities and civil society organizations will lead to a more inclusive, qualitative and focused act of governance. This article analyzes the aspects related to the legal regulation of this dialogue and cooperation in the Republic of Moldova, identifying which are the elements that encourage, facilitate the dialogue and those which are the factors that obstruct them. The author analyzes and presents the existing decision-making systems and its consultation mechanisms with civil society organizations in the Republic of Moldova, the existing opportunities for the involvement of CSOs in the process of developing public policies and effective practices. The paper also focuses on the value and impact of existing CSO consultation and participation experiences, including both participatory experiences resulting from calls made by public authorities and those resulting from civic initiatives. CSOs are one of key components of an open and democratic society, as they play a key role in strengthening democracy and the rule of law, and their dialogue with public authorities is a precondition for all of the above. When dialogue is undermined and CSOs are not involved in the development, monitoring and evaluation of public policies, the quality of governance decreases, resulting in the interests of citizens not being reflected in public policies, which ultimately leads to poorer levels of governance. Analyzing the development of dialogue between Moldovan CSOs and central and local public authorities (CPA / LPA), we found that PAs are not yet fully aware of the value of dialogue, which is sporadic and guided by certain interests, which do not always coincide with public interest.
A variety of research methods are used in the study, aimed at highlighting the particularities of the dialogue and cooperation between the public authorities and the civil society organizations, as part of the act of governance, studying the development over time and the influence of various factors on these processes. Thus, the historical analysis method, will be used to research the origin and evolution of the legal framework that regulates the dialogue and cooperation between public authorities and the associative sector of the governance act. The analysis of the relevant laws, regulations and policies, together with existing reports, studies and publications on the subject of research, alongside with individual and group interviews with representatives of relevant central and local public institutions, civil servants from different administrative levels, national and local experts, representatives of NGOs, CSOs and academia are among other methods employed in this research. The comparative analysis is also used in the research. A number of recommendations are listed to address the issues identified.
